Here is the report from TSN tonight. Thanks to Flo for spotting this.

OILERS, SENATORS AGREE TO DEAL, ASK HEATLEY TO WAIVE NO-MOVE
TSN.ca Staff Report/June 30, 2009

Sources say Dany Heatley has been asked to waive his no-trade clause to go to Edmonton in exchange for Andrew Cogliano, Dustin Penner and Ladislav Smid.

If Heatley agrees to waive, it would appear the Sens and Oilers will have a deal, pending the official trade call with NHL central registry, but that is generally a formality.

Heatley informed the Senators in early June that despite having five-years remaining on a six-year contract extension that he recently signed that he wished to be moved. The contract calls for Heatley to make $7.5 million per season against the cap.

The veteran forward became unhappy with his role in Ottawa last season, especially after the Senators made a coaching change. Heatley discussed his concerns about what he felt was the limiting of his ice time, and his shift from the first power-play unit to the second unit with head coach Cory Clouston in the Senators end of season meetings.

The Senators have gone downhill since they appeared in the Stanley Cup Final in 2007.

In the 2007-08 season, the Senators had a hot-start, but then had a brutal second-half of the season and held on to seventh place in the Eastern Conference, only to get swept by the Pittsburgh Penguins.

This past season, the Senators never really got it going, and missed the playoffs.
Heatley notched 39 goals and 33 assists in 82 games last season. The 72 points were his lowest point totals in his four seasons with the Senators.

The 28 year-old, had back-to-back 50 goal seasons in 2005-06 and 2006-07.
The 26-year old Penner found himself in former Oilers' coach Craig MacTavish's dog house on more than one occasion during his two seasons in Edmonton.

Penner, who signed a five-year offer-sheet with the Oilers in 2007 has never really developed into the player that Edmonton hope. Last season, he recorded 17 goals and 20 assists in 78 games.

Penner has three-years remaining on his contract that will pay him $4,250,000 million per season.

Cogliano, who the Oilers drafted in the first round of the 2005 NHL Entry Draft has already played in two full NHL seasons.

In 2008-09, the 22-year old forward recorded 18 goals and 20 assists. He has one-year remaining on his three-year entry level contract that he signed in 2007.

The 23-year old Smid, has played three-seasons in the NHL. Last year, he recorded 11 assists in 60 games.

The 6'3" defensive man will give the Oilers some size on the blueline.
Penner, along with Smid both have ties to Senators general manager Bryan Murray from his time with the Anaheim Ducks.

Just in from Sportsnet:

Sens send Heatley to Oilers

Sources tell Sportsnet that the Ottawa Senators have traded disgruntled all-star Dany Heatley to the Edmonton Oilers for Andrew Cogliano, Dustin Penner and Ladislav Smid.

The Senators would have needed to pay Heatley a $4 milllion bonus at 12:01 am ET on July 1.

Heatley signed a six year, $45 million contract in October 2007, fresh off his second consecutive 50-goal season and a trip to the Stanley Cup Finals. But since then, things have gone downhill for both Heatley and the club. The sniper has scored 38 goals last season, while the Senators missed the playoffs for the first time since 1996.

Dany turned down a deal to Edm two days ago...

He has accepted this deal for Cogliano, Smid, and Penner I am told, the sens have yet to admit that however...maybe the Sens have another deal?

What deal did he turn down?

I am going out on a limb. Penner I think will do well on a line with Aflie and Spezza. Cog's will be a decent 2nd liner and will only get better as he improves on his face offs. Smid adds to a clogged defence so I am guessing murray has something else up. Smid is going to come into his own shortly and working with Clouston maybe even sooner. Gotta remember these players came from a team last year that did not do as well as it should have under a coach whose time had come and gone. I was hoping that a pick was involved.

ESPN.com (per Pierre Lebrun) is reporting the deal is pending Heatley's approval...

HEATLEY-OILERS DEAL HINGES ON NO-TRADE

Dany Heatley may have gotten his wish after all -- and just in time.

Multiple outlets reported Tuesday night that the Ottawa Senators have agreed to send Heatley to Edmonton for Andrew Cogliano, Dustin Penner and Ladislav Smid.

Heatley was due a $4 million bonus from Ottawa if he was still on the roster at 12:01 am ET on July 1.

TSN reported that the deal hinged on the disgruntled Heatley waving his no-trade clause.

Officials with both teams would not confirm a deal was imminent.

"Nothing to report," Oilers GM Steve Tambellini told ESPN.com's Pierre LeBrun when reached via phone Tuesday night.

Sources have confirmed that both teams were talking Tuesday night. Penner is the key Oiler that would be going the other way for Heatley, who asked for a trade in early June.

Heatley became disgruntled with his role under new coach Cory Clouston who took over for Craig Hartsburg in February. The two-time 50-goal scorer was demoted from the first power-play unit to the second team and expressed his dislike with the move with the team in end of season meetings.

Heatley signed a six-year, $45 million deal in October 2007 after the Senators reached the Stanley Cup finals the previous June. He will count $7.5 million against the cap in 2009-10.

Penner joined Edmonton as a restricted free agent after signing a controversial offer sheet in the summer of 2007, but had since fallen out of favor with then-head coach Craig MacTavish.

Cogliano and Smid, 22 and 23 years old respectively, provide the rebuilding Senators with more young talent to move forward with under Clouston.

Heatley scored 39 goals and 72 points in 82 games last season.

Information from ESPN.com's Pierre LeBrun was used in this report.

That Javman post is a cut and paste from Eklund.

I went to Eklund's site because Javman's last 5 posts have looked strange.

Bob McKenzie on TSN.ca at 12:12 AM...

Now, it gets interesting.

Dany Heatley did not waive his no-movement clause before midnight eastern to facilitate an agreed-upon trade between the Ottawa Senators and Edmonton Oilers that would have sent Andrew Cogliano, Dustin Penner and Ladislav Smid to Ottawa.

For now, and quite possibly forever, the deal is dead.

It gets interesting because while Heatley could change his mind at some point, the Senators are now responsible for a $4 million signing bonus payment that is due to Heatley on July 1. That is expected to greatly change the dynamic of any trade talks involving Heatley.

In other words, the price just went up if the Sens hope to recoup the money in the form of unloading contracts they don't want. Cash cannot change hands in an NHL transaction and the CBA does not allow the transfer of cash payments already made.

"But as it turns out, the NHL says as long as a Heatley trade is concluded before midnight eastern tomorrow night, the bonus payment allocation can be transferred to the new team."

The full text of the update by TSN's McKenzie as of 12:16AM...

A lot of confusion has existed because there is a $4 million bonus payment due to Heatley on July 1.

It was the understanding of many involved, including the Senators and Oilers, that once the clock struck midnight and turned over to July 1, the Sens would be on the hook for the $4 million bonus payment, which may have been a serious impediment to getting a deal done after midnight.

But as it turns out, the NHL says as long as a Heatley trade is concluded before midnight eastern tomorrow night, the bonus payment allocation can be transferred to the new team.

So, in effect, the Senators have another 24 hours to find a suitable deal that Heatley will approve and NOT be on the hook for his $4 million signing bonus.
