Pretty sure the league will say the 6 year contract goes with the 10% variance -- both were concessions on their part, from 5&5. Players have to be careful here because to anyone with a brain they are looking for loopholes to circumvent the cap. By doing this they are able to go over the cap to pay elite player more. Since there is no guarantee that cap hit is ever paid out in its entirety, they should only take payroll in calculating the players' share. If they do that that will create greater variance from year to year (because of the Parises and Suters of the NHL world). The players may not like that but they can't argue that it's not fair. Parity in the league will take a bit of a hit.
