I think he'll be great offensively in SJ for at least a couple of years, but I still don't think he's going to be the guy that puts them over the top in the playoffs. I also agree that we're better with this trade depth-wise, future/cap-wise and that minor detail... having players who actually want to be here.

Here is the only reference in the CBA that I can find that talks about a NMC being non-binding during a trade...

Snippet from CBA Section 11.8:

"If the Player is Traded or claimed on Waivers prior to the no-Trade or no-move clause taking effect, the clause does not bind the acquiring Club. An acquiring Club may agree to continue to be bound by the no-Trade or no-move clause, which agreement shall be evidenced in writing to the Player, Central Registry and the NHLPA, in accordance with Exhibit 3 hereof."

I can't find any mention of this applying when a player waives an existing no-trade/no-move clause. I'll continue looking...

I guess it comes down to interpretation. If those two sentences are mutually exclusive or not. I am not a lawyer so I assumed they were seperate statements.

That's only true if it had not taken into effect yet. i.e. if we had traded Spezza prior to July 1st, when his NTC kicked in, the acquiring team has the right to choose whether or not to honour it.

Yeah, so from what I could find out, Heatley's NMC is still intact.

The only time a player loses his NMC is if he is moved (waivers or trade) prior to his NMC or NTC kicking in and his new team decides against it.

Well, it's not unthinkable that the Sharks could have made the deal conditionally; They would have told Heatley "we'll only do this deal if you agree to rip off the NTC from the contract"; essentially renegociating part of the agreement. I assume that Heatley would have accepted that since it's still beats having to play in Ottawa.

I'm not saying that's what happened but I think that could have happened.
